In 2007 & 2008, we successfully opposed a number of bills seeking to alter the wording or penalties for FS 800.03 (indecent exposure).  These were dangerous because wording changes may have altered current case law that "mere nudity is not sufficient for conviction".  (FL Supreme Court, 1997)

 

Current Senate Bill 1428 (same as: House Bill 793) does not seek changes to 800.03, but references it in regard to warrantless arrests.  (FS 901.15).  Currently, a police officer must witness an act of indecent exposure to make a warrantless arrest.  If passed, this bill would allow a police officer to make a warrantless arrest on probable cause based on hearsay from a third party.

 

 

Warrantless arrests have validity when the commission of a crime is in progress, or in cases of hot pursuit.  However, we object to the inclusion of the misdemeanor 800.03 in the 901.15 laundry list of offences that allow an erosion of constitutional rights and the likelihood of false and grudge accussations from a person likely unfamiliar with statute or case law.  We oppose the elimination of the need for a warrant in this case, and therefore we oppose this bill with regard to 800.03.

 

No action is requested from naturists at this point, as SFFB works with our lobbyist and the Naturist Action Committee to try to modify the bill.

A new Naturist group is forming in Key West and the Lower Keys with the express mission to locate and establish a designated Naturist Beach, a "Free Beach" in Key West

Tom Chittenton, one of the founders of South Florida Free Beaches in 1980, is heading up the effort. He has quickly picked up several local naturists who want to get involved.

 

 

Richard Mason attended a March 20 meeting, representing SFFB/FNA. He presented the group with a brief history of the obtaining of Haulover Beach, Florida statute & case law, the US Constitution's "original meaning" and the opportunity for the local group to move forward at this time.

At the same time a public meeting was held at the roof top clothing-optional Key West restaurant, Garden of Eat'in; a media release had been published in the local newspaper. Over 25 people attended.  About 15 identified themselves as nudists/naturists, but all said they would visit a Naturist Beach if one was available.

It appears the group has agreed to be a SIG of SFFB and work as a committee, using the name Key West Free Beaches. This decision will be firmed up at their next meeting April 3.

On the next day, many members of the group attended a charrette style meeting of the Friends of Higgs Beach. Over 75 people attended including city and county officials. Higgs is a Monroe County property. The naturists broke up to attend several "break-out" meetings and present their idea of a designated Naturist Beach. Friends of Higgs is trying to clean up the beach and make it desirable to visit again.

We were all accepted and  welcomed. At the end of the meeting we were able to speak individually with a Key West City commissioner and a Monroe County Commissioner. We presented each with a Government Affairs packet.

KWFB is now included in the process, but Higgs may not be the best option. After the meeting several naturists visited Smathers Beach.  A decision will be made by KWFB as to which beach to pursue.

What is the connection between South Florida Free Beaches/Florida Naturist Association, Inc. and B.E.A.C.H.E.S. Foundation Institute, Inc?

 

SFFB/FNA is a Florida nonprofit corporation but not a 501 (c) (3).  Therefore donations to SFFB/FNA are not tax deductible.  SFFB/FNA functions in large part as a Politcal Action Committee and it maintains a FL legislative lobbyist in Tallahassee, with a mission to prevent the passage of any legislation harmful to naturist interests.  All current SFFB/FNA Board of Directors members are South Florida residents.

 

B.E.A.C.H.E.S. is a nonprofit corporation granted federal 501 (c) (3) status.  Donations to B.E.A.C.H.E.S. are tax deductible.   B.E.A.C.H.E.S.' mission is naturist education and obtaining capital & programming improvements at Haulover Beach.  A future goal is to extend these activities to other naturist beaches. B.E.A.C.H.E.S. Board of Governors currently includes individuals from a number of states (and one Canadian province) who are associated with SFFB/FNA, Central Florida Naturists, Tampa Area Naturists, Friends of Wreck Beach (Vancouver), Black's Beach Bares (CA), S.L.U.G.S. (OR), the Naturist Education Foundation and The Naturist Society.  (Listed board member associations do not however indicate control or participation of the named organizations in B.E.A.C.H.E.S.)

 

501 (c) (3) status is usually a prerequisite to apply for grant funding from government or from other non-government nonprofits (NGOs); however, this status does impose certain limitations on political action activity.  We hope this clarifies the need for two allied, but separate, entities.  The relationship mirrors that between the national Naturist Action Committee [PAC] and the Naturist Education Foundation [501 (c) (3)].
